Important: Adult incapacity guardianship under MHL Article 81 is never a Surrogate’s Court matter in New York. Petitions go to the Supreme Court.

How Article 81 Appointment Works

Under MHL §81.02, the Supreme Court may appoint a guardian of the person, the property, or both — but only after finding incapacity by clear and convincing evidence and that appointment is the least restrictive alternative available.

The court appoints a Court Evaluator (MHL §81.09) to investigate and report. The alleged incapacitated person retains the right to counsel and a full hearing. For SCPA Article 17-A, by contrast, the Surrogate’s Court grants plenary guardianship — a broader, status-based appointment without Article 81’s individualized tailoring.

Consider Alternatives First

A well-drafted Durable Power of Attorney, Health Care Proxy, living trust, or supported decision-making agreement — executed while a person still has capacity — can make a court proceeding entirely unnecessary. Review alternatives to guardianship before filing.

Ongoing Guardian Duties

Appointment is not the end of the process. Guardians in Monroe County must file an initial report and annual accounts with the court. Filing fees are set by statute and court schedule — confirm current amounts before filing. Contested proceedings involve additional hearings and costs.
